(68,644 posts)He was right to object to the state's failure to provide alternative treatment, and they were wrong to not offer it.
He was wrong in thinking that refusal to cooperate would be without consequences, he did nothing to mitigate these.
He took a principled stand with risks, where he could have accomplished the same degree of "justice" and mitigated the risk by cooperating and raising the very legitimate complaint while in the program.
I believe that the state was wrong to the tune of $2,000,000, but I strongly feel that his damages are pretty limited, he got 100 days based on the choice he made in how to fight the battle, he shares some of the blame.
Even then, $1,000/day would be quite generous; a $100,000 settlement would be reasonable, with a $1.9 M fine.
