In reply to the discussion: When does your religion legally excuse you from doing part of your job? [View all]drm604
(16,230 posts)54. Interesting article.
According to the article her objection is to having her name on the licenses. If this is true then it seems like this whole thing could be settled by what the article suggests:
And allowing all marriage licenses and certificates for opposite-sex marriages or same-sex ones to include a deputy clerks name, or just the notation Rowan County Clerk, wouldnt jeopardize any compelling government interest. To be sure, it would have to be clear that this modification is legally authorized, and doesnt make the license and certificate invalid. But a court that grants Daviss RFRA exemption request could easily issue an order that makes this clear.
It would be galling to accommodate her in this matter, but it could make the whole thing go away, including the publicity and the martyrdom aspect. It would remove an issue that Republicans are using to stir up their base and it wouldn't violate anyone's rights nor make things any more difficult for couples requesting licenses. As long as it's done for all licenses then everyone is being treated the same.

I find it interesting that that is your only comment, albeit a stupid one, on the OP.

The infinite array of possible religious objections based on rule of God are all made irrelevant by....the rule of law.
