1. Bush was in the WH, McCain was running for president and

countering the Biden/Democrats' Protect Our Children Act with a Republican bill mainly meant to confuse and derail. Then Oprah came out in favor of Biden's bill and McCain's bill disappeared.

However, the Democratic lead in the senate was razor-thin, and the Republicans were able to at the last minute, mostly unscrutinized by the press, slip through a couple provisions from McCain's bill, neither absolutely terrible but both something we wouldn't do. One of these terribly important provisions outsourced investigations to a private agency. I don't recall there was any good reason for them to take a line on creating opportunity for additional profiteering from child pornography, but including that got the bill passed instead of blocked.
