Court voids Trump campaign's non-disclosure agreement

A federal judge ruled Tuesday that a broad non-disclosure agreement that Donald Trump’s 2016 presidential campaign required employees to sign is unenforceable.

U.S. District Court Judge Paul Gardephe’s ruling generally steered clear of the constitutional issues presented by such agreements in the context of political campaigns. Instead, the judge — an appointee of President George W. Bush — said the sweeping, boiler-plate language the campaign compelled employees to sign was so vague that the agreement was invalid under New York contract law.

The vagueness and breadth of the provision is such that a Campaign employee would have no way of what may be disclosed, and, accordingly, Campaign employees are not free to speak about anything concerning the Campaign,” wrote Gardephe. “The non-disclosure provision is thus much broader than what the Campaign asserts is necessary to protect its legitimate interests, and, therefore, is not reasonable.”

Gardephe’s 36-page decision said a non-disparagement clause in the agreement was similarly flawed.

Will New York's Legislature Cancel a MAGA Park?

For a decade and a half now, motorists on the Taconic State Parkway, north of New York City, have been confronted by exit signs for a Donald J. Trump State Park. At first, the name was merely curious; unlike hotels, mixed-use towers, and deli sandwiches, state parks are rarely named for reality TV stars or blowhard real-estate developers. After the past six years, however, the name is still curious but also, for many, grotesque. Help may be on the way.

Like America, Donald J. Trump State Park is split in half: one section, totalling a hundred and fifty-four acres, is in Yorktown Heights, in Westchester County; the other, made up of two hundred and eighty-two acres, straddles the border between Westchester and Putnam Counties. Trump bought the land between 1998 and 2000, intending to build twin golf courses, but after environmental concerns scotched that plan—uh-oh, wetlands!—he donated the parcels to the state. The “understanding,” according to a letter from his attorney, countersigned by a representative of the state, was that “each of the properties will bear a name that includes Mr. Trump’s name . . . prominently displayed at least at each entrance.”

The State Legislature has become determined to do something about this. The cause gained steam after January 6th, and bills that would strip Trump’s name from the park are pending votes in the state senate and Assembly. At a joint legislative hearing in January, Commissioner Erik Kulleseid, of the state Office of Parks, Recreation and Historic Preservation, testified that his staff was “reviewing” just how binding the old letter of understanding would be if the legislation becomes law. There’s a big gray area here: yes, the former President is famously litigious, but his lawyers will likely be battling on many fronts in the next few years. “I doubt he’ll have the resources to care about that when the time comes” is how Assembly Member Daniel O’Donnell, a Democrat from the Upper West Side, put the odds of a suit at the hearing.

Although Trump paid just shy of three million dollars for the land at the end of the nineteen-nineties, he later claimed that his gift, bestowed in 2006, was worth more than twenty-six million. In 2015, a campaign spokesperson made an even more lordly valuation—a hundred million. Whether such figures made their way onto Trump’s tax returns as writeoffs is precisely the type of thing Manhattan District Attorney Cyrus Vance, Jr., is said to be investigating.

T-Mobile Set to Shutter TVision Just Six Months After Launch

TVision, T-Mobile’s vaunted “uncarrier” reinvention of the pay TV business, is exiting the market, literally just six months after it launched.

T-Mobile announced Monday that it will “wind down” TVision’s Vibe and Live tiers on April 29. As part of a newly announced broad-ranging deal with Google, the wireless company has tapped Google’s virtual MVPD, YouTube TV, as its official premium pay TV service. T-Mobile will also promotionally bundle another vMVPD, Philo.

For starters, T-Mobile learned that there’s a reason the linear pay TV companies it has mocked for so many years are weighed down so much by their programming contracts. T-Mobile launched trying to simultaneously market a super-skinny, $10-a-month entertainment-only, Philo-like “Vibe” tier, next to a more robust, more traditional looking trio of “Live” bundles. That revolutionary approach didn't end well.

Biden's true tax priorities

President Biden is preparing to go to the mat for four tax increases worth about $1.8 trillion to help pay for his infrastructure and social safety net plans, advisers tell Axios.

Driving the news: Biden will outline an array of tax proposals beginning on Wednesday — an opening bid ahead of months-long negotiations mostly within the Democratic Party — but these are his priorities.

By the numbers: The biggest-ticket item would raise the corporate rate from 21% to 28%. That's worth $730 billion over 10 years, according to the Tax Policy Center.

The other three would:
- Impose a global minimum tax on profits from foreign subsidiaries: $550 billion.
- Tax capital gains as regular income for the wealthy and tax unrealized capital gains at death: $370 billion.
- Return the top individual rate for those making more than $400,000 to the pre-Trump rate of 39.6%: $110 billion.

Biden admin remakes vaccine strategy after mass vaccination sites fizzle

The Biden administration is rethinking a costly system of government-run mass vaccination sites after data revealed the program is lagging well behind a much cheaper federal effort to distribute doses via retail pharmacies.

The government has shipped millions of doses to the 21 mass vaccination hubs, or “pilot” community centers, in states such as California, Florida, New York, Illinois, Massachusetts and Texas. The hubs are part of a $4 billion federal system that funds more than 1,000 smaller vaccination locations across the country and provides other vaccination support — such as supplies — to states across the country. The Federal Emergency Management Agency did not respond to repeated questions about how much the pilot sites cost.

Despite the money the federal government has spent on the mass-vaccination pilot sites, they are administering just a fraction of the shots given across the country each day. Federal data show the retail pharmacy program — which has signed up 21 chains and 17,000 stores — can reach far more Americans in a shorter time, according to four senior officials with direct knowledge of the matter. The bottom line, those sources said, is that more Americans seem to be willing to walk to their local pharmacist to get the vaccine than to travel to a federal vaccination site for the shot.

That represents a shift in strategy for the Biden administration, which touted the hubs as a powerful tool to rapidly accelerate the nation’s vaccine rollout and a symbol of the president’s push to give the federal government a larger role in the pandemic response. But FEMA data obtained by POLITICO make clear that the pharmacy sites are far outpacing the stadiums, arenas and convention centers enlisted as mass vaccination sites.

Capitol riot suspect wore 'I Was There' shirt when arrested

Garret Miller didn’t speak to the law enforcement officers who arrested him on charges he stormed the U.S. Capitol in January, but the T-shirt he was wearing at his Dallas home that day sent a clear and possibly incriminating message.

Miller’s shirt had a photograph of former President Donald Trump, and it said “Take America Back” and “I Was There, Washington D.C., January 6, 2021,” federal prosecutors noted in a court filing Monday.

Prosecutors are urging a judge to keep Miller jailed while he awaits trial on charges stemming from the Jan. 6 riots in the nation’s capital.

On a recorded call immediately after his arrest, Miller told his mother, “I don’t feel that I’ve done anything wrong and now I’m being locked up,” according to prosecutors.

Ghislaine Maxwell faces new criminal charges as U.S. expands indictment

NEW YORK (Reuters) -U.S. prosecutors on Monday expanded their criminal case against British socialite Ghislaine Maxwell, unveiling a new indictment adding charges of sex trafficking conspiracy and sex trafficking of a minor.

Maxwell, the longtime associate of late financier Jeffrey Epstein, now faces an eight-count indictment that also accuses her of enabling his sexual misconduct, as well as perjury.

The original indictment, to which Maxwell had pleaded not guilty, accused her of helping Epstein recruit and groom three teenage girls for sex between 1994 and 1997.

Monday’s amended indictment adds a fourth victim, saying that between 2001 and 2004 Maxwell and Epstein recruited an underage girl to engage in sex acts with Epstein at his home in Palm Beach, Florida.

Biden to announce 90% of adults will be vaccine eligible in three weeks

(CNN)President Joe Biden will announce on Monday afternoon that 90% of adults will be eligible to get a coronavirus vaccine within the next three weeks as well has have a vaccination site within five miles of where they live.

According to a White House statement, the President will announce that the US will increase the number of pharmacies participating in the federal pharmacy vaccination program from the current 17,000 locations to 40,000.

Additionally, the White House said the federal government "will stand up a dozen more mass vaccination sites by April 19," which includes two new sites in Gary, Indiana, and St. Louis, which were announced earlier Monday. The administration will also establish a new transportation program in partnership with community organizations to get at-risk seniors and people with disabilities access to the vaccines.
