Marsh 3 sex suit: Attorneys spar as millionaire's lawyers seek delay

Amarillo millionaire Stanley Marsh 3 was booked into the Potter County Detention Center on Thursday after Potter County officials filed 14 criminal charges.

Attorneys for Stanley Marsh 3 and a man suing Marsh 3, his wife and longtime associate David Weir over child sex abuse claims sparred Thursday over a motion to delay taking depositions from potential witnesses for three months.

District Judge John Board conducted a brief pretrial hearing Thursday on pretrial discovery motions filed by attorneys for Stanton Coldiron, an Amarillo man who sued Marsh 3 last month.

On May 1, Coldiron, 21, filed a civil lawsuit against the Amarillo millionaire, Wendy Marsh, Weir and two Marsh 3 entities — SM3 LLC and Barb Wire LP — in Potter County. The suit alleges Coldiron was 16 when he met Marsh 3, who systematically seduced, molested and sexually abused the teen over a six-month period in 2008.

The other defendants, the suit said, aided, abetted and conspired with Marsh 3, 75, in his sexual abuse of Coldiron.

I expect the defense attorneys to continue filing delays and continuances until the pervert is dead. Marsh 3 has already put up a $300,000 bond and although he was booked at the detention center there is no indication as to whether or how long he was actually detained.

Unpopular Speech: The Price of Freedom

By Dr. Brian Carr

What Does Free Speech Mean?

Among other cherished values, the First Amendment protects freedom of speech. The U.S. Supreme Court often has struggled to determine what exactly constitutes protected speech. The following are examples of speech, both direct (words) and symbolic (actions), that the Court has decided are either entitled to First Amendment protections, or not.

-snip-

Freedom of speech includes the right:

1. Not to speak (specifically, the right not to salute the flag).
West Virginia Board of Education v. Barnette, 319 U.S. 624 (1943).

2. Of students to wear black armbands to school to protest a war (“Students do not shed their constitutional rights at the schoolhouse gate.”).
Tinker v. Des Moines, 393 U.S. 503 (1969).

3. To use certain offensive words and phrases to convey political messages.
Cohen v. California, 403 U.S. 15 (1971).

Dewhurst tweet says bill attempt to close clinics

AUSTIN, Texas —

Texas Senate Republicans insist proposed new restrictions on abortion facilities are designed to protect women's health, but a tweet Wednesday from Republican Lt. Gov. David Dewhurst suggested supporters of the measure hope to close clinics and all but ban the procedure in the state.

Senate Republicans shoved aside Democrat objections late Tuesday night to pass sweeping new regulations on Texas clinics that critics warn would force most facilities to close.

Over several hours of debate, Republican supporters acknowledged they hoped to reduce the number of abortions — about 78,000 in Texas annually — but insisted they were trying to raise the standard of health care for women seeking the procedure.

Less than 12 hours after the bill was sent to the House, Dewhurst tweeted a map from the Stand With Texas Women abortion rights campaign showing the locations of clinics that would likely be forced to close along with a warning the Senate plan "would essentially ban abortion statewide."

As Johnny Manziel has learned, it's too late to take back that tweet Dewhurst. Thanks for confirming the Republican agenda in Texas so that there is no doubt how much you believe in small government and the women's reproductive rights.

I'm not on Twitter, so I'll have to use this venue instead: REPUBLICANS ARE ASSHOLES!

Happy Juneteenth from a Land Where Old Times are Forgotten

Interesting story in The Dallas Morning News today by Selwyn Crawford about growing national popularity for Juneteenth, a holiday originally thought to be strictly a Texas thing. Juneteenth marks the official emancipation of slaves in Texas in 1865, two years after Abraham Lincoln's Emancipation Proclamation.

My family just visited a part of the Old South, where we toured the home of a slave-owner. Slavery was described by our tour guide in terms I took as morally neutral. The spiel focused on the wealth of the slave-owner. In mid-19th century, steamy hot, coastal South Carolina he could afford imported ice for his wine. The slave quarters were off-limits to visitors.

Crawford's piece accurately describes a debate over Juneteenth as strictly a black thing. Should Juneteenth be the big holiday, or does that overshadow and diminish the importance of Lincoln's historic proclamation?

-snip-

One of those consistent themes is a particular kind of depravity that owning another human being can bring about in the so-called owner. After all, it was this depravity of whites that inspired the first white abolitionists. The Grimke sisters of South Carolina, for example, were driven to the cause by the animalistic cruelty of whites that they witnessed on their own family plantation.

Sports Corp. recommends converting Astrodome into massive convention center

Saying none of the 19 privately submitted ideas for repurposing the Astrodome met the required criteria, Harris County Sports and Convention Corp. officials said they will recommend converting the Dome into a massive convention and exhibition space, promising "a new Dome experience."

"We feel we have the best idea," Sports Corporation Executive Director Willie Loston said. "That idea is a space that will allow many of the ideas that the proposals brought forward to take place."

Under the plan being recommended by the Sports Corp., the roof of the dome would be lowered, seating removed and the existing below-ground portion of the stadium would be filled in to create a street-level exhibit space. The result will be 355,000 square feet of exhibit space. The exterior of the structure would transformed into "an inviting green plaza" of restaurants and retail.

The proposal will be officially presented to Harris County Commissioners Court at its June 25 capital improvement projects meeting.

Texas A&M’s Johnny Manziel nearly transferred before Heisman Trophy winning 2012 season

Even as Texas A&M quarterback Johnny Manziel’s recent tweet about wanting to leave College Station is widely dissected, it’s only now becoming clear just how close he came to departing the school and town before the “Johnny Football” sensation ever occurred.

A&M initially suspended Manziel for the 2012 season following his arrest in College Station’s Northgate bar district last summer, a source with knowledge of the situation told SportsDay.

Manziel, entering his freshman season after sitting out the 2011 season as a redshirt, would have felt it was necessary to transfer if the suspension wasn’t overturned on appeal, according to the source.

Manziel won the appeal, allowing the Heisman Trophy winning season in A&M’s 11-2 SEC debut and the rise of the Aggies to transpire.

Manziel was arrested for misdemeanors of fighting, failure to identify and possession of fake IDs around 2 a.m. on June 29, 2012.

(Texas) Senate OKs abortion measure in late vote

Source: Austin American-Statesman

The Texas Senate approved a sweeping abortion measure late Tuesday night despite spirited opposition from Democrats who warned that the proposal would make it extremely difficult, if not impossible, for most Texas women to receive the procedure.

Republicans insisted the bill will improve women’s health care by requiring abortion facilities to be vastly improved, doctors to more closely monitor drug-induced abortions and physicians to obtain admitting privileges in a nearby hospital should complications arise.

Democrats and abortion rights advocates, however, said concerns for women’s health are a ruse hiding the bill’s true intent: to shut down most Texas clinics and otherwise make abortions more difficult or expensive to obtain.

“This isn’t about making women safe, is it? It’s about political primaries and making sure you are feeding the red meat to the people who are voting in those primaries,” said state Sen. Wendy Davis, D-Fort Worth.

Pet Food Recall: Dog, Cat Food Contaminated With Salmonella

Natura Pet Products today recalled six different brands of dog and cat food over potential Salmonella contamination.

The recall was made after a U.S. Food and Drug Administration (FDA) test returned positive for Salmonella on a single sample. The products being were all packaged in the same production facility as the positive sample.

Natura Pet Products manufactures pet food and treats markeded as “natural” and “holistic.” The recall includes dry dog food, dry cat food, and pet biscuits/bars/treats branded Innova, EVO, California Natural, Healthwise, Karma, and Mother Nature with expiration dates prior to June 10, 2014.

The company has released a statement through its website apologizing and stating that additional testing procedures have been implemented for its products. The statement, in full:

Dear Natura Family,

We have some sad news to share. We are announcing today a voluntary recall of all Innova, California Natural, EVO, Healthwise, Mother Nature and Karma branded dry pet food and biscuit/bar/treat products with expiration dates prior to June 10, 2014.

We made this decision in part due to a single positive Salmonella test by the FDA on product manufactured April 3. Normally, this would have resulted in retrieval of product manufactured over just a few days. However, we are taking the additional precautionary measure to recall all products in the marketplace. Our first priority is the wellbeing of the pets we serve.

Our decision allows us to ensure that all products available in the marketplace were produced after June 10, the date when we implemented additional finished product testing procedures with the guidance of industry experts.

Below this message you will find instructions on how to request a replacement voucher or refund. If you have any further questions, please contact us at http://www.naturapet.com/about/contact-us or (800) 224-6123.

We are truly sorry. We know this news disappoints you; we are disappointed too. Natura will always focus on high-quality ingredients, product safety and innovation in pet nutrition. We remain committed to making products you can trust.

Sincerely,
Employees of Natura Pet Products

Conflicts, Motives, and Ego

By Carol Morgan

I’ve had a lifelong fascination with others’ behavior and the reasons for their actions. Because of that experience, I try to examine my personal “whys” almost daily.

All of us should regularly re-examine our motives and intentions for our actions; it allows us to determine if we’re maintaining momentum for our life’s purpose or drifting off course. It also prevents us from unconsciously harming others, temporarily blinded by the reward we receive.

Many of us fail to reflect on our personal motives because it requires being quiet and still, away from distractions, and most importantly, being truthful with ourselves. Sometimes, our motives are simple and straightforward, but other times, unbeknownst to us, we do things to compensate for our insecurities, escape our fears, gain approval and affirmation from others, fulfill other people’s expectations, escape pain or boredom, or to assuage our guilt and shame.

The laundry lists of pay-offs that we fail to acknowledge is long and we waste a lot of time, energy, and money to obtain that emotional currency.
