Following his nomination to the Supreme Court, Neil Gorsuch was packaged by his wealthy benefactors as the judicial equivalent of a carrot cake: mild and wholesome with the occasional hint of spice. Now that the justice has been safely installed on the court for life, he has revealed himself to be more akin to melted sorbet: sickly sweet and insubstantial with a tangy finish that induces slight nausea. Gorsuch’s abrupt pivot to arrogance has been on full display in his bumptious opinions and questions from the bench. But it also appears to be infecting his interactions with justices behind the scenes. Whispers emerging from the court indicate Gorsuch is more likely to alienate than influence even his conservative colleagues.

The latest sign of trouble comes from NPR’s Nina Totenberg, who dropped in on the indispensable Supreme Court podcast First Mondays to dish some gossip about the newest justice. Totenberg, a renowned court reporter who is friendly with several justices, noted that Gorsuch “ticks off some members of the court—and I don’t think it’s just the liberals.” Without exposing her sources—“you talk to former law clerks, you talk to friends, you talk to some of the justices”—Totenberg then dropped a bombshell:

My surmise, from what I’m hearing, is that Justice [Elena] Kagan really has taken [Gorsuch] on in conference. And that it’s a pretty tough battle and it’s going to get tougher. And she is about as tough as they come, and I am not sure he’s as tough—or dare I say it, maybe not as smart. I always thought he was very smart, but he has a tin ear somehow, and he doesn’t seem to bring anything new to the conversation.

North Carolina Minister 'Repossesses' Dead Child's Headstone as 'Leverage' to Collect Family's Debt

A North Carolina pastor has “repossessed” the grave marker of a 5-year-old who died of leukemia, because the bereaved family still owed his company money for the monument. Wayne and Crystal Leatherman, who buried their son a year ago, say they’re in shock.

“He repossessed it, like it was a car,” the boy’s mother told WBTV.

JC Shoaf, a Baptist minister who owns Southeastern Monument company, countered that the couple needed to pay up. He told the station that the family initially paid for the stone, but were in debt after requesting a number of changes that “added 400 pounds to the size of the marker and $2,500 in additional costs,” per local outlet News & Observer.

If you buy something, you’ve got to pay for it. No matter what it is,” Shoaf told the news site. “I told (Wayne) I would take it up if they didn’t pay. I was told: ‘Go ahead.’ They probably owe less than $1,000 on it.”

“I hated to do it. I’m not heartless and I have had a child die, so I know how it feels. But what was I to do? I thought having (the marker) would give me some leverage. In hindsight, I should have just written it up as a bad debt...This could ruin my reputation. Hopefully, we can get this resolved, even if I take a loss on it.”

Guess Who Breitbart and Sarah Palin Are Blaming for the California Wildfires?

A collection of right-wing websites teamed up with half-term nitwit Sarah Palin to spread a fake news story that appeared to pin the Northern California wildfires that have tragically killed at least 40 people onto an immigrant man who was arrested at a park in Sonoma, California.

Jesus Fabian Gonzales—who “often sleeps in the park and is well-known to law enforcement”—was arrested Sunday after starting a small fire that he says he lit to stay warm, and one that “was so small a responding sheriff’s deputy was able to mostly put it out before firefighters arrived.” Gonzales was taken into custody without incident for one count of arson, but by Tuesday, Breitbart, InfoWars, and other sites were blaring sensationalist headlines, including one that stated that the “homeless arsonist behind Calif. wildfire that killed 40 people is an illegal alien”:

Breitbart News and InfoWars offered no evidence to link the man’s arrest to the fires and their accounts of the man’s arrest were disputed the same day by Sonoma County Sheriff Rob Giordano.

“There’s a story out there he’s the arsonist for these fires. That is not the case. There is no indication he is related to these fires at all,” Giordano said in a news conference also broadcast on the department’s Facebook page and area TV stations. “I just did want to kill that speculation right now so we didn’t have things running too far out of control.”

Warning of 'ecological Armageddon' after dramatic plunge in insect numbers

The abundance of flying insects has plunged by three-quarters over the past 25 years, according to a new study that has shocked scientists.

Insects are an integral part of life on Earth as both pollinators and prey for other wildlife and it was known that some species such as butterflies were declining. But the newly revealed scale of the losses to all insects has prompted warnings that the world is “on course for ecological Armageddon”, with profound impacts on human society.

The new data was gathered in nature reserves across Germany but has implications for all landscapes dominated by agriculture, the researchers said.

The cause of the huge decline is as yet unclear, although the destruction of wild areas and widespread use of pesticides are the most likely factors and climate change may play a role. The scientists were able to rule out weather and changes to landscape in the reserves as causes, but data on pesticide levels has not been collected.

White nationalist to control which journalists cover Florida 'free speech' event

A white nationalist has been given full control over which journalists will be permitted to cover his “freedom of speech” event at the University of Florida on Thursday, a university spokeswoman said, a situation one expert called “ironic”.

“They’ve rented the facility. It’s their event. It’s not our event,” university spokeswoman Janine Sikes said on Wednesday. “It’s their event, so that’s why they can have whomever they want.”

White nationalist Richard Spencer, who is headlining the event, has the authority to handpick which journalists can cover his speech or deny access to any journalists at all, first amendment experts at the University of Florida said.

Spencer’s group has also been given complete control over who will receive audience tickets. The group announced they will hand out tickets in person about an hour before the speech starts, a plan one student organizer called “volatile” and “a huge danger”.

The university’s negotiations with Spencer appear to have “unfortunately sacrificed” journalists’ first amendment rights, said Clay Calvert, the director of the University of Florida’s Marion B Brechner First Amendment Project.

Trump just lost a big court case because hes a terrible liar

There is a very silly dance underway between the Trump administration and the federal judiciary.

Not long after taking office, President Donald Trump issued his long-bragged-about Muslim Ban, which prohibited nationals of seven Muslim-majority countries from traveling into the United States. Almost immediately, the ban ran into trouble in the federal courts.

The ban has now made several trips through the federal judiciary, including a number of visits to the Supreme Court — with the justices temporarily halting at least some parts of the ban, and then dissolving most of that order for jurisdictional reasons. Meanwhile, the Trump administration made two rounds of tweaks to the ban, at times explicitly admitting that these tweaks are intended solely to increase the likelihood that the ban will survive in court.

After the first round of tweaks, for example, Trump described the second version of the Muslim Ban as a “watered down version of the first one” that was crafted “by lawyers in response to prior legal challenges.” He also said that his preference was that “we ought to go back to the first one and go all the way, which is what I wanted to do in the first place.”

EPA steps in as Puerto Ricans grow desperate for clean drinking water

The Environmental Protection Agency has hired contractors to repair fencing around a federally designated, hazardous waste site and “local security is stationed at the wells to prevent access,” the agency said, after reports surfaced that residents — desperate for drinking water — were taking water from a toxic well.

Puerto Rico’s water utility, Autoridad de Acueductos y Alcantarillados, had been distributing water from a well at the Dorado Groundwater Contamination Site, which was added in 2016 to the federal Superfund program for hazardous waste cleanup. The utility was reportedly unaware that the site was contaminated until CNN contacted it with Superfund maps. Superfund sites are highly contaminated toxic sites targeted by the federal government for cleanup because of risks to human health and the environment.

A water truck and bottled water have been stationed in the western Dorado well area to provide water to residents, the EPA said in an email to ThinkProgress.

But almost a month after Hurricane Maria struck the island, more than 35 percent of the island’s residents still lack access to safe drinking water.
