Ohio conservatives consider 'license to abuse' bill for parents of transgender kids

The last thing trans kids need are these kinds of obstacles to affirming care.

Conservatives in Ohio are pushing a bill that would make it incredibly easy for parents to block their transgender kids from accessing the care they need. It’s perhaps one of the most dangerous anti-trans bills that has been introduced in any state.

The legislation is response to a case from earlier this year when a judge took custody away from parents who rejected their transgender child. The teen was diagnosed with gender dysphoria and was prescribed hormone therapy to help resolve the depression and anxiety associated with that dysphoria, but his parents rejected his gender identity and prohibited him from accessing any of those treatments. According to the teen, they once forced him to sit and listen to six hours of Bible verses.

After reaching out to a crisis hotline, the teen was admitted to a hospital, and the doctors refused to return him to his parents’ custody because of how unsafe he felt with them. A judge ultimately granted custody to his grandparents, who “accept their grandson for who he is.”

H.B. 658 is specifically designed to make sure the state can never intervene when parents are rejecting their transgender children as such. It lays out a litany of provisions that undermine transgender kids’ safety at every turn, including even their basic access to information about their identities. Here are just a few of its effects:

Supreme Court just wrote a presumption of white racial innocence into the Constitution

The Supreme Court held on Monday that white lawmakers enjoy a presumption of racial innocence, even when they draw legislative districts that empower white voters at the expense of racial minorities.

The thrust of Justice Samuel Alito’s opinion in Abbott v. Perez is that the “good faith” of a “state legislature must be presumed,” even when there are very serious allegations of racial gerrymandering. The facts of Perez are unusual and unlikely to repeat in the future, but Alito’s presumption of white racial innocence could have a significant impact on future cases.

In 2011, Texas drew racially gerrymandered maps. At the time, the Supreme Court had not yet struck down a key provision of the Voting Rights Act. Thus, the 2011 maps could not take effect until after they were “precleared” by federal officials in Washington, D.C. A federal court in D.C. ultimately concluded that the maps were not legal.

That meant that, with the 2012 elections rapidly approaching, Texas did not have any valid maps that it could use in that election. Worse, though a Texas federal district court drew maps that the state could have used in the upcoming election, the Supreme Court vacated these maps. Thus, in late January of 2012, Texas still had no maps, and primary elections were only a few months away.

The result was a rushed, March 2012 decision by the Texas court which laid out interim maps. Many of the districts in this hastily drawn interim map closely resembled the racially gerrymandered districts drawn by the state legislature in 2011. The Texas court, moreover, emphasized that “this interim map is not a final ruling on the merits of any claims asserted by the Plaintiffs in this case or any of the other cases consolidated with this case.”

Gorsuch says he'll repeal and replace the Fourth Amendment with something terrific

This is not how judges are supposed to behave.

As a presidential candidate, Donald Trump offered a vague promise to repeal and replace the Affordable Care Act with “something terrific.” On Friday, Neil Gorsuch, who occupies the seat on the Supreme Court that Senate Republicans held open until Trump could fill it, brought a similar amount of thoughtfulness and coherence to the question of when police should be allowed to conduct a search without a warrant.

Gorsuch’s dissenting opinion in Carpenter v. United States is an odd piece of writing. It reads less like a judicial opinion and more like the sort of essay that an overworked law professor might toss off after they suddenly realize that they have a symposium paper due at the end of the week. After lecturing his colleagues for 20 pages about how he has uncovered a way of interpreting the Fourth Amendment that is more “tied to the law” than the last half-century of Supreme Court opinions on this subject, Gorsuch outright refuses to apply this mysterious new interpretation to the case at hand.

Carpenter asked whether law enforcement can, without first getting a warrant, use cell phone records to pinpoint where a particular suspect traveled over a course of weeks, months, or potentially even years. A majority of the Court — Chief Justice John Roberts plus the four liberal justices — held that the answer to this question is “no.”

Until its final pages, Gorsuch’s dissent reads as if he agrees with the majority’s conclusion — it’s only at the very end that Gorsuch reveals he is casting a vote in favor of the government because the lawyers on the other side failed to anticipate the specific way that Gorsuch wants to repeal and replace a half-century of established law.

WaPo editorial board: Sarah Sanders 'should be allowed to eat dinner in peace'

The Washington Post editorial board defended White House press secretary Sarah Huckabee Sanders on Sunday after she was kicked out of a Virginia restaurant.

The “never-at-rest social media” has blurred the lined of public and private life, the newspaper’s board wrote.

“It wasn’t the first time recently that strong political feelings have spilled into what used to be considered the private sphere,” the editorial board wrote. “We understand the strength of the feelings, but we don’t think the spilling is a healthy development.”

Earlier this week, Homeland Security Secretary Kirstjen Nielsen’s dinner at a Mexican restaurant in Washington, D.C., was interrupted by protesters.

New fears over Chinese espionage grip Washington

Fresh concerns over Chinese espionage are gripping Washington as lawmakers fear Beijing is gaining sensitive details on U.S. technologies.

Lawmakers are scrutinizing the Pentagon over its efforts to keep military secrets safe from hackers, after Chinese actors allegedly breached a Navy contractor’s computer and collected data on submarine technology.

U.S. officials stepped up warnings that China regularly steals American intellectual property and technology, through cyberattacks and other means — allegations Beijing denies.

The issue took center stage at a congressional hearing Thursday, as lawmakers on the House Armed Services Committee pressed Trump administration officials on their efforts to protect U.S. military assets from Chinese spies.

Pentagon identifies Navy pilot killed in New Mexico crash

A Navy pilot who was killed in an A-29 aircraft crash in New Mexico on Friday has been identified as Lt. Christopher Carey Short of Canandaigua, N.Y.

The Navy said late Saturday that Short was killed when the A-29 he was flying crashed on a mission over the Red Rio Bombing Range, near Holloman Air Force Base.

“There's no way to describe the shock of this loss and the sadness we feel for his family,” Col. Houston Cantwell, commander of Holloman's 49th Wing, said in a statement.
“He did pioneering work in aviation that will help shape American air power for years to come. We're thankful to have known him and grateful for his devotion to duty.”

Two pilots were aboard the A-29, which was taking part in the Air Force’s Light Attack Experiment when it crashed at about 11:30 a.m.

The other pilot “suffered minor injuries and was airlifted to a local hospital,” the 49th Wing said in a statement Friday.

The cause of the crash is under investigation.

Trump admin created challenge coin featuring Mar-a-Lago

The Trump administration created a special challenge coin featuring President Trump’s Mar-a-Lago estate, The New York Times reported Sunday.

The White House Communications Agency, a military unit that designs and creates the coins, created the Mar-a-Lago coin in recent months.

The group has also designed coins featuring Pope Francis and Trump, and killed plans for a coin featuring Trump Tower in Manhattan and the president’s golf course in Bedminster, N.J. after the Times asked about the coins.

The agency — the same group that created a highly publicized coin for Trump’s summit with Kim Jong Un — also created a “Make America Great Again” coin that was funded by the Republican National Committee, according to the Times.

Challenge coins are often created to mark presidential trips or events.

Ethics watchdogs told the Times that coins depicting Trump’s properties shouldn’t be created with government resources, as it could violate federal laws banning the use of public resources to promote private institutions.

Romney: I will speak out against Trump on issues of 'substantial significance'

Mitt Romney said Sunday he will continue to speak out against President Trump when he sees fit, but acknowledged that he agrees with a number of the president's policies.

Romney, who is running for U.S. Senate in Utah, penned an op-ed for The Salt Lake Tribune, in which he sought to clarify his stance on Trump, whom Romney has alternately criticized and praised dating back to his own 2012 presidential campaign.

"If you elect me your senator, I will fight with vigor for the interests of our state and nation. I will endorse the president’s policies that support those interests. Hopefully, there will be few occasions where I will be compelled by conscience to criticize," Romney wrote.

"But, as I have said throughout this campaign, I will call them like I see them. Last week, the president said that I’m a straight shooter; I will endeavor to be just so," he added.

Sessions warns against obstructing border police

Attorney General Jeff Sessions issued a warning on behalf of the Department of Homeland Security, saying that regardless of what anyone thinks of Trump administration immigration policies, obstructing or abusing border and customs officials will not be tolerated.

"Free speech, assembly, and protest are and will be protected," Sessions said in a statement issued Saturday evening. "But obstructing law enforcement or committing other crimes will not be tolerated."

Tensions over the Trump administration's immigration policies — particularly those that have led to the separation of children from their families — have spilled over into the public treatment of everyone from Border Patrol and Immigration and Customs Enforcement agents to one of Sessions’ fellow Cabinet members.

Sessions' warning comes after online activists have threatened to dox ICE employees by attempting to publicly shame those who work for the agency, and others have vowed to use tactics similar to the occupy movement to grind immigration enforcement to a halt. According to the Willamette Week in Oregon, ICE "temporarily halted" operations in Portland after protesters blocked the front entrance to a facility there.
