Utah’s new custody law aimed at giving both parents equal responsibility

A new law which went into effect this week encourages the state courts to award equal child custody following divorce or separation.

House Bill 35, sponsored by Representative V. Lowry Snow of St. George, combats the outdated family court tradition of awarding sole custody to one parent - usually the mother - about 80 percent of the time. The bill creates amendments for an optional parent-time schedule of 145 overnights, sets holiday schedules and provides for specific elections by the noncustodial parent.

The National Parents Organization applauds Utah for being one of the first states int he nation to pass shared parenting. It’s even mentioned in the Wall Street Journal story, “Big Shift Pushed in Custody Disputes.”

The story revealed nearly 20 other states are actively considering shared parenting legislation.

YouTube may show 'Innocence of Muslims' film: U.S. court

Google Inc should not have to remove an anti-Islamic film from its YouTube website because a woman complained that she was duped into performing in the film that depicted the Prophet Mohammed as a pedophile, a U.S. appeals court ruled on Monday.

In a case widely followed for its potential impact on the entertainment industry, an 11-judge panel of the 9th U.S. Circuit Court of Appeals in San Francisco said an injunction prohibiting Google from broadcasting the film should be lifted.

A three-judge panel had ordered Google to remove the controversial film "Innocence of Muslims." Billed as a trailer, it triggered anti-American sentiment among Muslims in Egypt, Libya and elsewhere in 2012.

For many Muslims, any depiction of the prophet is considered blasphemous.

Supreme Court Says Convicted Felons Can Sell Their Guns

A unanimous Supreme Court says the government can't prevent a convicted felon who is barred from possessing firearms from trying to sell his guns after they are confiscated by authorities.

The justices ruled Monday in favor of Tony Henderson, a former U.S. Border Patrol agent arrested and charged with distributing marijuana. He had turned over his collection of 19 firearms to the FBI as a condition of his release.

After pleading guilty, Henderson wanted to sell the weapons to a friend or transfer them to his wife. But lower courts said allowing him to sell them would technically give Henderson possession in violation of the law.

The high court said letting a convicted felon transfer possession is permitted as long as the felon has no control over the weapons.

Seymour Hersh (2012): JFK as immoral as Oswald and Sirhan

He said this based on his unproven allegation that JFK backed assassination attempts on Fidel Castro (in fact the evidence points to the CIA going behind JFK's back to do this). Recall that CIA helped kill Lumumba n without JFK's authorization either. Anyway Hersch is a very irresponsible journalist. Now back to the 2012 article:

“The morality of JFK in comparison with Oswald and/or Sirhan,” are “obvious questions,” wrote Hersh — whose latest story for the New Yorker alleges that the United States is training members of an Iranian terrorist group in Nevada. The 35th president’s backing of assassination attempts against Cuban dictator Fidel Castro, Hersh explained, meant that he was as immoral the men who took his and his brother’s lives.

Asian Americans file complaint alleging discrimination in Harvard admissions

More than 60 Asian American organizations filed a complaint (see below) with the federal government on Friday alleging that Harvard University discriminates against Asian Americans in the admissions process and calling for an investigation.

The Harvard Crimson, a student newspaper on campus, wrote in this story that 64 groups filed the complaint with the U.S. Education and Justice departments, arguing that the university makes an “unlawful use of race” in its decisions that hurts Asian Americans.

More than 21 percent of the admitted students for the current school year were Asian American, according to Harvard data. Asian Americans comprised the largest minority group accepted, the data shows. In the Class of 2017, admitted four years earlier, Asian Americans comprised 19.9 percent.

Lesbian partner isn't 'parent' of baby born through artificial insemination, appeals court rules

Karah Fisher met Lorrena Thompson in 2004. The women hit it off, exchanged vows and rings during a commitment ceremony in 2005, then bought an inn on the Oregon coast that they managed together.

After Lorrena Thompson was artificially inseminated in 2007 and gave birth the following year, the two changed their last names to "Madrone" to share it with the child.

The couple split, however, in 2012. And Lorrena Madrone cut Karah Madrone off from regular visits with the child -- saying she was the child's sole legal guardian. Karah Madrone fought for the right to see the child, and a Circuit Court judge determined -- in accordance with Oregon law -- that she indeed had parental rights to her partner's child.

But this week, the Oregon Court of Appeals overturned that decision -- saying a lesbian partner doesn't automatically become a parent just because her partner gives birth to a baby through artificial insemination and she approves of it. The court ruled that one other standard must be met: The partners must have wanted to marry, had same-sex marriage been an option.

Fla. woman who fled to avoid son's circumcision is arrested

A Florida woman who fled to avoid the circumcision of her son was arrested Thursday for contempt of court, her attorney said.

Heather Hironimus went missing with her 4-year-old child nearly three months ago, going into hiding as her long court battle against the surgery reached its climax. Though her defenders said she was simply doing what she could to protect a child portrayed as "scared to death" of the procedure, a judge issued a scalding rebuke for her refusal to appear in court, charging her with contempt and issuing an arrest warrant.

She was taken into custody Thursday, her attorney Thomas Hunker said, declining to release further details. Her name did not yet appear in inmate databases and calls to jail officials went unanswered.

Both sides are under a gag order in the case and Hunker did not disclose the whereabouts of the child.
