Democrats warn GOP: Don't fill a Supreme Court vacancy in 2020 or we'll retaliate

Senate talk of a potential — but uncertain — opening close to a presidential election has reignited a clash over the future of the court.



Democrats are warning Republicans not to fill a possible Supreme Court vacancy this year after denying President Barack Obama the chance in 2016, saying it would embolden a push on the left to add seats to the court whenever they regain power.

"We knew basically they were lying in 2016, when they said, 'Oh, we can't do this because it's an election year.' We knew they didn't want to do it because it was President Obama," Sen. Tim Kaine, D-Va., said in an interview.

Kaine, the party's last vice presidential nominee and a lawmaker with a reputation as an institutionalist, said confirming a nominee of President Donald Trump this year could compel Democrats to consider adding seats to the high court.

"If they show that they're unwilling to respect precedent, rules and history, then they can't feign surprise when others talk about using a statutory option that we have that's fully constitutional in our availability," he said. "I don't want to do that. But if they act in such a way, they may push it to an inevitability. So they need to be careful about that."

In a sweeping statement of intent, the Democratic National Committee is poised to add language to the party's 2020 platform endorsing "structural court reforms to increase transparency and accountability."

The draft language, reviewed by NBC News and expected to be approved later this month, denounces Republicans as having "packed our federal courts with unqualified, partisan judges who consistently rule for corporations, the wealthy, and Republican interests" and for "blocking a Democratic president from appointing a justice to the Supreme Court."

Bernie Sanders Is Asking for Masks for All

A national campaign to encourage mask wearing, including the distribution of free masks, would help to check the pandemic.

Senator Bernie Sanders of Vermont introduced legislation this week that directs the Trump administration to send three “high-quality, reusable” masks to every person in the United States, and would provide $5 billion to increase mask production. This is a good idea.

Wearing masks saves lives, and not just other people’s lives. There’s evidence that it limits the chances of catching the coronavirus. Wearing a mask might save your life, too. Sending masks to every American won’t convince them all to wear a mask. It is not a corrective for the behavior of Representative Louie Gohmert, Republican of Texas, who has flaunted his refusal to wear a mask, and who said Wednesday that he had tested positive for the coronavirus. But distributing high-quality masks would provide Americans inclined to behave responsibly with masks that maximize health benefits.

And it would make it easier for those with doubts about masks to slip one on.

The legislation also directs the Trump administration to ensure that medical workers have a sufficient supply of the most effective protective masks, known as N95 masks. It’s unfortunate that the Trump administration requires this kind of prodding. Ramping up of the domestic production of protective gear should have been an urgent national priority months ago. Instead, Americans have endured a familiar mix of bluster, denials and half measures.

The virus continues to spread freely here, even as other nations have brought it under control.

Think "building maintenance," and you probably imagine plumbing, a new coat of paint, or a replacement toilet-paper dispenser.

But when the Republican National Committee in June spent more than $14,000 on "building maintenance," none of its facilities were getting a face-lift.

Instead, the RNC purchased face masks designed to limit the spread of COVID-19, according to Insider interviews and a review of federal campaign-finance disclosures released earlier this week.

The RNC ordered the masks at a time when President Donald Trump and other prominent Republicans were refusing to cover their faces in public. The purchases show Republican leaders were taking the coronavirus more seriously than they'd been publicly letting on.

Trump's Tulsa Rally Didn't Draw a Big Crowd. But It Cost a Lot.

New campaign filings show that President Trump’s campaign paid more than $2.2 million for the event, which drew a sparse crowd that disappointed his campaign.

President Trump has held only one campaign rally since the pandemic swept across the country in March. It not only failed to fill the arena in Tulsa, Okla., it was also very expensive.

New campaign filings submitted Monday afternoon showed that Mr. Trump’s campaign paid more than $2.2 million in event, facility and audio visual costs in June — a month where the Tulsa event was his campaign’s only major public-facing event.

Mr. Trump, whose spirits have long been buoyed by his rallies, had pushed a chance to speak before a cheering and packed crowd but the event, held as fears of the coronavirus were increasing, ultimately left much of the 19,000-person arena unfilled. The sparse crowd helped accelerate the demotion of his campaign manager, Brad Parscale, who had said the campaign fielded one million ticket requests.

The new filings show just how much Mr. Trump’s campaign paid to rent the arena itself: $537,705.44 in “facility rental” payments to the BOK Center. But that fee was just the start.

The campaign then paid nearly $1 million in “event staging” fees between June 16 and the end of the month to eight different companies. The most went to Arcus Group, LLC, which received $673,906 in two payments for “event staging,” one a few days before the rally and another a few days after.

The campaign similarly made two payments totaling more than $426,000 to LMG, LLC, for “audio visual services,” right before and after the rally. The payments in the campaign filings do not specifically list that they were for Mr. Trump’s Tulsa rally but he held no other major, political event for the public last month.

The Trump campaign declined to comment.

It's the only way we will get thru this pandemic and it's economic fallout. We have to get thru it all together.

Joe Biden will be facing enormous challenges immediately on being sworn in as president. The need for social justice, economic fairness, and managing the covid-19 pandemic will demand the most from Joe and all our national leadership, going back to a pre-Trump status quo simply is no longer adequate.

I am hopeful though, because I do believe Joe Biden cares. I firmly believe he has what it takes to be a transformative president.
