(713 posts)The US Attorney General (Sessions) has no authority over the New York State Attorney General, which is the Office that Schneiderman is resigning from. One is Federal (Sessions) and the other is New York State (Schneiderman). Preet used to be a US Attorney General for the Southern District of New York, a Federal Office. If Preet were appointed, he would be a New York State AG, no longer a Fed.
Again- The New York State AG is part of the New York State Government. It is entirely separate from the Federal Government. The Federal Justice Department and the New York State Attorney General's Office are entirely independent of each other. One is State, the other Federal, both with separate powers, different laws (State versus Fed), and different governments. Sessions would not have the power to fire the NYS AG.
If Preet were appointed, he would have to run for election in November anyway. I think it would be good to appoint him, since as a sitting NYS AG, he would be in a stronger position to defeat whatever Republican who might run against him in the Fall. It would also be poetic justice if Preet were elected, since he would then be in a position to investigate any State Crimes committed by Trump and his Lackeys, who are the people that were dumb enough to fire him in the first place.
Also, as has been pointed out by others, the President has no Power to issue Pardons over State charges. Trump could only issue Pardons for those convicted of Federal Crimes. The NYS AG can investigate and prosecute Trump and his Chronies under State Law, completely separate from the Feds. Completely different jurisdictions.
Preet would be a strong candidate, given his previous work as a U.S. Attorney (Federal). He is also known in New York State political circles as the guy who brought corruption charges against allegedly corrupt New York State Legislature leaders. That would be Dean Skelos, a former Republican State Leader, and Sheldon Silver, a former Democratic State Leader, both former leaders in the State Legislature that Preet brought charges against (still working its way through the Courts).
Preet would make an excellent NYS Attorney General, for a number of reasons, including his experience bringing Federal corruption charges against those former New York State Government figures. As I said, it would also be poetic justice if Preet ended up prosecuting Trump and his Cronies, for crimes. They were the people dumb enough to fire him from his US Attorney position to begin with.
