First Amendment to the Constitution says CONGRESS shall make no laws respecting an establishment of religion, or prohibiting the free exercise thereof. There's nothing about the executive branch just doing it without Congress. The courts may think otherwise if they try it. And if the Russpublicans hack the vote so they stay in power, Congress might just try it.
