The notion is simple. The agreement typically includes no fine print: shyster games -- such as holding one in technical default if one fails to say "Mother, may I?" before eating Beano in a month without Rs -- are seldom seen in the Land of Bail. And in any case, those who put up cash, or guarantee to pay cash, usually have advice from clever counselors who will explain, in advance and in detail, the exact meaning of "If the accused fails to appear in court as ordered, you will forfeit your cash and/or pay the guarantee"
So bail is not, under usual understandings, anything like a bilk or a scam or a swindle
