AFAIK all of the states in question have already passed laws stating that the electors are to be chosen by the party of the candidate who wins the state's popular vote. IOW, legislatures have already decided that the will of the people will determine the electors. The legislatures can only choose directly if the election should 'fail' and be unable to be certified, which again can only occur if there are serious problems (beyond the typical minor election issues), which a court would have to rule on.
