If the House and Senate voted to reject the Electoral vote count, they would be doing so pursuant to the law set up for that purpose. That is not insurrection.

The same thing applies to suing Pence. They are using the legal process to get what they want - and the courts, once again, smacked them down. That's how democracy works.
