(2,740 posts)Does it give a sitting President the power to "contest and election" and "oppose the certification of the vote". Its not there. There is no such power or right. The Constitution spells out specifically how the electoral process works - and there is no contingency for the sitting President to encourage citizens to oppose The Constitution.
Ignorance is no argument here. Donald Trump can't argue that he did not intend on what we saw - destruction and death as an attempt to stop the electoral count. This is because there was no way to "oppose" the electoral certification from a Constitutional standpoint. Therefore, the only thing Trump could be encouraging the crowd to do was lawless.
There is NO reason he should not have already been charged with inciting violence. A local Antifa-type has already been charged, tried and convicted of "inciting violence" here in Tallahassee for simply calling on people to stop Trump supporters from storming The Capitol if they tried. There was no violence. But he was charged, tried and convicted. For inciting violence that didn't happen. Didn't even make national news.
