25. A private party can file a lawsuit claiming the same elements

as in a criminal RICO case. The RICO statute contains a specific provision under which a private party, usually a business entity, can file a civil suit in federal court against a person, corporation or other entity claiming they violated the RICO statute in the same manner as if there was a criminal prosecution. The plaintiff would have to prove by a preponderance of the evidence that, in violation of 18 USC §1962, the defendant participated in the conduct of an enterprise via a pattern of racketeering activity, and that as a result the plaintiff’s business was injured.
