If we're talking about running pictures in news outlets, then there is a very strong first amendment case for it. It is news, it happened in public, it is in the public interest to know about these things. There are measures you can take to protect the privacy of victims and their families. It's no different from covering war, or any other kind of crime for that matter.

Using these images in political ads, I feel, is a different matter... not for legal reasons as much as it a matter of tact. Not everyone wants images of their dead child used in political ads, and that should be respected.
