[View all]It's important to recognize the difference between "treason" at the constitutional definition, and the common use meaning of the word. January 6 was a seditious attempt at insurrection with the aim of keeping Trump in power. Despite the fact that Biden won the election, those active in the conspiracy to keep Trump in office by force have made two things clear: they believed the election was stolen, and they were engaged in an action they believed the president wanted them to do.
I know this sounds like splitting hairs. In the common use of the word, I agree 100% it was treason. Yet they believed they were taking a patriotic action to keep the then current president in office. Their target was the two houses of Congress, to disrupt and keep them from doing their duty. Thus, they are at most being charged with a conspiracy per sedition. There is no chance that Trump can or will be charged with treason, as the head of the effort.
