(46,346 posts)As a few others have noted here, there is zero chance of Trump being charged with, let alone convicted of, treason.
Indeed, it is more likely than not that he won't be charged with anything relating to January 6 -- for example, while Judge David Carter (District Court Judge in California) offered his opinion (not a legal finding) that Trump likely is guilty of a felony attempt to obstruct congress -- a crime punishable by a maximum of five years -- I don't believe that charge will be brought nor could a conviction be obtained. Carter acknowledges that Trump working with Eastman to develop a legal strategy for contesting the outcome of the election can't be the basis for a criminal charge. The distinction he tries to draw between Eastman and Trump discussing legal strategy and Trump discussing the January 6 strategy of having Pence reject the certification of electors from certain states and accept alternate electors is pretty attenuated.
