The doj knew documents were there because (a) they saw them in June, (b) they have been in touch with trumps lawyers who likely confirmed they were still there.

Trump was unwilling to return them.

It would be a slam dunk to get a warrant to search and seize based on those conditions.

It's really simple. It's not political. It's a pedestrian physical crime.
