He doesn't surrender or get the Russian armed forces bruised any further, and he might be able to negotiate some land concession.
Sort of the "stop me before I kill again" gambit. And then let the lawyers sort it out.
Personally, I think he should make a big parade out of Ukraine, declaring victory and the elimination of all vestiges of Nazis in Ukraine. And let the lawyers sort it out.
We don't know if this was a renegade Russian commander, a purposeful provocation, a technical glitch. KAL 007 had over 200 victims, including a US Congressman. Russians.
