because both are possible, but mitigating are favorable to the defendant whereas aggravating are unfavorable.
Aggravating circumstances might, for instance, include being a flight risk (but they might just require him to turn in his passport) or being a danger to self or others (which in his case might be addressed by a gag order.)
His behavior in the courtroom might influence the judge's decision, but his lawyers know that and, if they could padlock his mouth (as was done to Papageno in "Die Zauberflöte"
, they probably would, and are certainly doing everything else they can to make sure his mouth stays zipped.
