why he is labeled Witness #5 rather than Individual #2. At least for part of this and thus far as not having been arraigned. But in direct answer to the question I don't honestly know. It seems from what we know that he knew what sort of crooked dealings Individual #1 was all about. So I think it feels like willing participation at this point. I don't know and I would hope that Smith can get what he needs from other ways to get convictions of them both.
