To be included. They havent yet, but they could. Not sure how that works with the SoL or if it could.

Even if it's appealed, doesn't Judge Merchan have the discretion to place Trump in custody in the meantime?

Alito has no say in this. It is entirely within the NY State Justice system. He will always be a convicted felon.
