In the court of public opinion, it is. For instance. If a President lied to get us involved in a war or mishandled a pandemic, and you referred to him as a murderer, you would never be found guilty of defamation. It's an opinion based on events of a well-known public figure.

Defamation, by definition, is based on public opinion. You could never be convicted by using the same words that a sitting judge used describing the same event.

ABC would have never lost in court. They caved out of fear of the oncoming dictatorship.
