The stops most be brief and investigative. All he did was to expand the basis of the Terry stop to include ethnicity.

Just like a Terry stop, the stop must be brief and investigative. The case did not expand what is permitted to happen after the stop - if the investigation creates enough evidence to justify more action.

So from a legal perspective, as to the stop itself, he is correct.

Unfortunately, from the perspective of ICE, they have taken it as a license to do more - and it will take a court case to see how far the court will go as to what is legally allowed after the stop.

So his speaking out may be an indication that when that case comes the outcome may be different. But since the courts weren't built for rapid response, and entities that are aren't interested in curbing ICE way too many people will be kidnapped and brutalized before this madness stops.
