34. It's defamation if you say something you KNOW to be false. It isn't if you believe what your saying to be true

They would first have to somehow establish this is not a murderer and saying so is false (and it is completely valid that someone might believe what he did is muder based on what is publicly known and seen). Then going forward it would be defamation to say it knowing this is proven false. Anything said prior to this is not defamation if the speaker believed it to be true and reasonably so.
