37. "Even if they do nothing"?

Please note that assault includes acting in a threatening way. A person can be guilty of assault without touching anybody.

If an ICE agent approaches you on a public sidewalk and asks them if they are a citizen, in a non-threatening way, that is perfectly legal. But nobody has to answer that question. You can simply ignore them and continue n your way.

If they then tell you to stop or else you will be detained, that is an assault if they do not have a judicial warrant naming you specifically.

People should turn on their camera as soon as the agent approaches them (many people do this), and call 911 just as soon as the ICE agent speaks to them. Don't speak to the ICE agent. Tell the 911 operator, "There is a masked man with a gun approaching me and I feel I am being threatened. If he makes any direct threats, I will press charges for assault. Please send a police officer."

That way the assault will be recorded on the 911 system in addition to your phone.
