(57,936 posts)I don't think you have to join anything or admit to anything to answer for international crimes. And the International Criminal Court did not exist when we held the Nuremburg trials of NAZI war criminals.
Seems to me if we are not members of the International Criminal Court, Americans who commit war crimes could still be subject to international prosecution.
It is rather ironic that our government claims the authority to kill by drone and without trial our own nationals who plot with Al Qaeda against us, but thinks somehow that Americans who similarly act outside the bounds of international law an human decency cannot be prosecuted simply because we did not join the International Criminal Court.
Seems to me that the Court will decide over whom it has jurisdiction. Criminals usually don't just give themselves up. Sometimes they do, but not all that often.
