He pursued someone because of how he looked - i.e. he profiled Trayvon - against the advice of the law enforcement professional he was speaking to on the phone. Had he followed the advice of the law enforcement professional, he would NOT be on trial today and Trayvon Martin would be alive.
He pursued Travon with malice, as per the telephone conversation he had with the law enforcement professional. And he killed him.
THAT is why he has been charged with 2nd degree murder.

If he was getting beat up, and the police are 5 minutes away, that doesn't do a lot of good.
