Two, unless there's some weirdness in FL law, they can still let the jury find him guilty of manslaughter, which is what I have all along thought the prosecutor was really after. They just made it 2nd degree murder because you always go into a negotiation with your max position, not the one you want to end up with.

If he was getting beat up, and the police are 5 minutes away, that doesn't do a lot of good.
