Since the state can't prove Zimmerman had the gun out or displayed when he approached Martin, Martin would have no LEGAL right to start a fight, no matter how creepy he felt Zimmerman may have been.
The case is going to come down to who the jury thinks struck the first blow, does the jury believe Zimmerman's injuries were caused by Martin and if yes, do they believe those injuries would cause a reasonable person to be in fear of death or grave bodily harm.
