(312 posts)It is not like the GZ case or the old cop in the theater. There was no physical assault or interaction by anyone prior to this shooting. We can argue about many things but this is a very important part of this case and a very important point in most states laws. In this I am not saying that the GZ or the old cop case were justified, only that this case is different than them.
We are allowed to defend ourselves against what a reasonable person would believe, in that very instant in time, is a threat to life or great bodily harm. In some states we are allowed to initiate this defense without attempting to retreat. (SYG Laws)...
When you try and say that this is what you were doing when there was no physical altercation or weapon found you are reaching. In this case his claim of self defense will not work. There is no clear reason or event that he had a right to defend himself against. The shooter claims he saw a gun but then had to retreat to his car to recover his own firearm. When he got to his car he was no longer being threatened.
It just does not work that any reasonable person would think that the use of deadly force was needed per the events at that instant in time.
