They offered $65 million and Carlyle wants $120 million. If Missoula wins, they'll get it for fair market value which will likely be some value in between.
Based on what is in the article, I think Missoula will lose unless they can prove that Carlyle is grossly negligent in maintaining the water system and they have to take over to protect the public. The fact that Carlyle makes money is irrelevant.

No reason for it to go to the Supreme Court, the only thing to dispute is fair value
