board is the presumption that the due process that Awlaki was entitled to involved an Article III court process while he was a fugitive.

Nothing could be further from the law, and the truth.

As a non-custodial active member of AlQaeda, Awlaki deserved kill or capture. Had he turned himself in (and let's not forget the Yemeni murder conviction) he would have been entitled to all the protections outlined in Boumediene v. Bush.

Let me ask you something---when you get a parking ticket, does your due process rights mean you get an attorney? A grand jury? Or, is your means for redress---your due process--- different than if you commit a felony?
