You're worried a perspective jury may vote to acquit this guy because they share the same views on this subject. One safe guard against this is having the lawyers to vet the potential jurors and weed out the undesirables. Without that safeguard, you would end up with juries like we have here sometimes who vote in favor of the people they like.
