He's 63 and seems (you can never tell) like he will be far more of a swing vote than Kagan or Sotomayor. If Clinton wins (especially if the Senate goes blue), she will likely ask Obama to withdraw the pick and she will make her own pick (which -- you never know -- could be Obama). If Trump wins, the Democrats will very possibly delay the pick indefinitely to show their displeasure over Garland. Whereas if Garland were approved now, Trump would have a much easier time replacing RBG and Anthony Kennedy.
