The Trump Foundation's registration category is EPTL, which means it is registered under the Estates Powers and Trust Law. In order to solicit contributions exceeding $25,000, the entity also has to be registered under Article 7-A which allows it to solicit funds.
In other words, all anyone at the Trump Foundation had to do was check the public record to make sure it was properly registered to solicit funds. If the improper registration was just overlooked, they would have caught it when re-registering. It looks bad on several fronts for so many years to pass and no one caught it.
