21. I agree that the photo was in poor taste. I don't agreee that it is evidence of a crime.

Franken is clearly not actually touching the woman. It also seems clear to me that the photos was a gag taken with the woman's knowledge, most probably by the tour photographer. How else can we explain the fact that Franken allowed the photograph to be taken and copies were distributed to all the crew present including the woman herself?
