(27,751 posts)...according to right-wing logic, the legislature could submit its own, ad hoc slate of Trump electors, and the SCOTUS could then rule that the Constitution specifically authorizes "state legislatures" to decide how electors are to be appointed, and that therefore the Trump slate must be the one accepted.
Not likely to work, but it would be a real shit-show, because you'd get two sets of electoral votes from PA (etc.) showing up, with two resulting "final electoral college tallies," one giving Biden 306 EV and the other giving Trump 270+, and Congress might decide to blow off the SCOTUS ruling, since there's nothing in the Constitution giving the judiciary any authority in determining electors. (Incidentally, since it would be a matter of competing totals, and not a failure of either candidate to get a majority, it wouldn't be decided by the House state delegations, either. In short, we'd have a full-blown constitutional crisis, and likely a second civil war.)
