(12,940 posts)As a general proposition, one spouse should not be responsible for the crazy things done by the other. (A rule upon which my wife insists.) We would at least hope that Justice Thomas did not participate in his wife's seditious actions. The rub is that we have known from the beginning that Justice Thomas is every bit as much the wingnut as his wife.
A judge or justice probably ought not be required to recuse from any given case because of the political activities of his or her spouse. A judge or justice should recuse from a case if there is the appearance of impropriety. However, I have no reason to believe that Justice Thomas holds himself to that standard. Unfortunately, there is no appeal from a Supreme Court justice's decision to not recuse.
