Proponents argue that the language created a right but the Constitution is pretty clear all states have to be approved by Congress, it doesn't devolve that right to states themselves.
I will edit to say if they did, don't know how they could do it without at least three of the five states being pretty blue given the geographical distance between the various blue pockets.
One state is guaranteed to be dominated by EP.
I don't see how you don't have one that isn't dominated by Austin/SA.
Then you'd have Dallas and Houston.
I suppose you could create a mega blue state with Houston/SA/Austin. Another solid blue with EP. A third purple state with Dallas and then two mega red states with Lubbock and then sort of middle Texas that isn't Austin or Dallas.
Still that's probably a net negative for republicans so five states is never going to happen even if it could.
