Because that would mean that Pence had lost in a lower court, appealed, and SCOTUS refused to hear the appeal, which means the lower court ruling would stand.
But yes, the nuances of scheduling an appeal in front of SCOTUS could tell us something, however, we must remember in all cases in which Trump was a named party that came before SCOTUS, they ruled against Trump, often quickly.
