I'm no expert, but I don't think there was a law enumerated in Exodus, Leviticus, Deuteronomy or elsewhere that the People could kill a man who pulled out.

Yes. "should be rooted" is not the same as "is rooted". He ruled as if former was the latter. . . . nt
