one person is already dead, the other is not dead.

It's easy to say you are okay with someone being dead AFTER they are dead via an accident.

That is not quite the same as saying you are okay with someone dying if they hadn't died.

I recall that story about the guy killing the rapist. The guy went back to his truck and got a gun then went over and shot him. That's premeditated murder. The guy chose to be judge, jury and executioner.

The guy who strangled the baby, will have the benefit of a trial (I hope, it being china and all), and will hopefully serve a life sentence.

As for the guy who chose to kill the rapist, yes, there is extenuating circumstances and I hope he has a good lawyer, but never the less, he should serve time for killing someone.
