And hands up according witnesses and the palm entry, facing the LEO, not away. Could have been fleeing just as said; and the sound of the shot at the building may have made him turn around to say 'don't shoot.'
As you say, rage is not a defense. No less than a case of manslaughter, but it looks more like murder. By definition, murder is an unlawful killing, even if it's by a lawman. That seems to be forgotten, even though authorities have more leeway as they are trained to use lethal force as a last resort, if there is a threat to life. That killing is ceded to them in a nation where people kill daily.
I want a trial to see what the witnesses say and what possible way he could ever defend this, as I don't think he can. He might plead to a lesser charge like manslaughter. But he can't just walk away from this altogether. And the FBI is on the case, now.
