Most historians agree with this position. Of course the Nazis exploited it in much the same way that the US government exploited 9/11, even though their own documents captured after the war show that they privately believed that Marinus Van der Lubbe acted alone and wasn't part of any organized commuinst plot.

However I am pleased to see someone else- even if it's a Ron Paul supporter- finally making this comparison to the Nazis. These are exactly the sort of powers they gave the Gestapo (i.e. arrest without charge, indefinite detention, no legal rights for detainees) when it was first created.
