In the U.S. almost all hate crime laws are measured against the First Amendment. I'm not sure but I think the UK standard is unwritten and based in common law. And then it must be measured against the EU human rights legislation. Despite the unclarity in US speech jurisprudence, it seems to me the European model has a lot more obstacles to a clear standard.
