WV Senate overturns concealed weapon bill veto

The West Virginia Senate on Saturday morning overturned Gov. Earl Ray Tomblin's veto of the permitless concealed carry bill.

House bill 4145 now becomes law.

The Senate approved the veto by a 23-11 vote.

Bill introduced to repeal law protecting gun industry from lawsuits

The bill introduced last week to repeal the Protection of Lawful Commerce in Arms Act has been fleshed out with text. The Equal Access to Justice for Victims of Gun Violence Act, or H.R. 4399, was introduced in the House on Feb. 1 by Rep. Adam Schiff (D-Cali.) to repeal the decade old law that shields gun makers and dealers from litigation if an individual uses their products to intentionally harm another person. “Good gun companies don’t need special immunity from the law, and bad gun companies certainly don’t deserve it,” Schiff said in a statement, and suggested the gun companies be regulated more intensely like car, drug and tobacco companies. “There is no reason to give the gun industry the right to act negligently,” he added.

According to the bill’s language, the measure would allow gun violence victims to seek civil remedies by bringing suits based on “statutes and common law theories of liability” in state and federal court PLCAA greatly limits the type of civil lawsuits that could be brought against gun companies, but it still permits lawsuits in civil cases that involve defective products, fraud, negligence, or violations of federal regulations. The law made headlines last year when a judge cited it in an order to dismiss a case against the retailers that sold products to the gunman responsible for killing 12 and injuring 70 in a movie theater in Aurora, Colorado, in July 2012.

Plaintiffs in the case argued the businesses should have had a stricter vetting policy before selling ammo, tear gas and body armor to the buyer, who had a documented history of mental illness. The order resulted in the plaintiffs, parents of one of the 12 killed, having to pay $200,000 of the defendants’ court costs. Also, the bill would allow plaintiffs to use information from the Firearms Trace System database as evidence to support a lawsuit. The system, maintained by the Bureau of Alcohol, Tobacco, Firearms and Explosives, contains information that shows how often a dealer sells guns that end up seized in crimes but, per federal law, is off limits to the public.

However, trace data that is available shows the number of crime guns recovered by authorities by state. The ATF updates that information annually. The bill has 39 co-sponsors, all Democrats, and has been assigned to the House Judiciary committee. Schiff originally introduced the bill in January 2013, but it died in Congress.

Arrest Warrant Issued for Bill Cosby for Alleged January 2004 Sexual Assault of Andrea Constand

An arrest warrant has been issued for entertainer Bill Cosby for allegedly drugging and sexually assaultingformer Temple employee Andrea Constand at his Elkins Park, Pennsylvania mansion in January 2004, sources tell PEOPLE.

Constand was not available for comment but one of her attorneys expressed gratitude toward the prosecutor.

"Obviously we appreciate the expression of confidence in her," says Dolores Troiani of her client, Constand, 42, who is now a massage therapist in Ontario, Canada. "We'll have to see what happens. We hope justice will be done. We will cooperate fully."

Cosby has previously said what happened between him and Constand was consensual, but in new court filings last summer Constand said she was in a relationship with a woman at the time. She also called Cosby a "narcissist" who missed cues that she's gay.

Arizona, Nevada Governors Slam Brown’s Comments on Gun Laws

CARSON CITY, Nev. (AP) — Nevada Gov. Brian Sandoval is hitting back at comments California Gov. Jerry Brown made about other states’ gun laws after the deadly shooting in San Bernardino.

Brown said earlier this week that Nevada and Arizona’s looser gun laws are “a gigantic backdoor through which any terrorist can walk.”

The Democratic governor was responding to some California lawmakers’ call for tightening the state’s already strict gun laws.

In a statement Sunday, Sandoval spokeswoman Mari St. Martin called Brown’s characterization “wrong and irresponsible.”

Venezuela opposition claims win in elections

Leaders of Venezuela's opposition are saying they won a majority of seats in legislative elections ahead of the announcement of official results.

"Venezuela won," former presidential Henrique Capriles celebrated on Twitter. A source within the anti-government camp told The Associated Press that the coalition believed it had won around 100 seats in the 167-seat legislature.

The National Electoral Council has yet to announce results and the opposition claim could not be confirmed. The ruling socialist party has not commented on the results

Former NAACP chapter head comes clean on “The Real”

Rachel Dolezal has a shocking confession for the world: She wasn’t born black.

Dolezal, the former president of the Spokane chapter of the NAACP who grabbed headlines and raised eyebrows earlier this year by claiming that she’s black, despite her parents saying otherwise, dropped the bombshell during Monday’s episode of talk show “The Real.”

“I acknowledge, I was biologically born white, to white parents,” Dolezal admitted.”But I identify as black.”

The admission didn’t come without some tooth-pulling; asked by the panel whether she actually walked the walk as a black woman, Dolezal offered a wobbly response.


So, after years of lying about her race and other lies, she finally comes clean.

Dad who shot 'snooping vid drone' out of the sky is cleared of charges

A father who shot down a drone that was hovering over his family home in Kentucky has been cleared of all charges.

Dad-of-two William Merideth thought the quadcopter was spying on his daughters in their yard in Hillview, and blasted the gizmo out of the sky with a shotgun. That earned him the title "Drone Slayer" from pro-privacy quarters.

Merideth was arrested shortly after in July, and charged with criminal mischief and wanton endangerment.

He appeared before the Bullitt County District Court on Monday this week, and after a two and a half hour hearing, Judge Rebecca Ward dismissed the case against him.
