Grrrrr: Judge Aileen Cannon, a Trump appointee, initially assigned to oversee his case

The summons sent to former President Donald Trump and his legal team late Thursday indicates that U.S. District Judge Aileen Cannon will be assigned to oversee his case, at least initially, according to sources briefed on the matter.

Cannon's apparent assignment would add yet another unprecedented wrinkle to a case involving the first federal charges against a former president: Trump appointed Cannon to the federal bench in 2019, meaning that, if Trump is ultimately convicted, she would be responsible for determining the sentence – which may include prison time – for the man who elevated her to the role.

A federal grand jury voted to indict Trump on at least seven federal charges late Thursday as part of an investigation into his handling of classified documents, sources familiar with the matter told ABC News. The indictment comes after more than 100 documents with classified markings were found at Trump's Mar-a-Lago resort in August 2022.

Trump has repeatedly denied any wrongdoing and claimed again late Thursday that he was innocent.

Witness tampering or other means of obstructing a criminal proceeding, is among the charges

@charlie_savage
on Trump lawyer Jim Trusty mentioning that Section 1512, witness tampering or other means of obstructing a criminal proceeding, is among the charges

On CNN, Trump’s lawyer Jim Trusty said that Trump’s legal team had not been shown the indictment itself, but that the summons commanding Trump to appear in court had “some language in it that suggests what the seven charges would be.” He mentioned the Espionage Act, multiple false-statement charges and “several obstruction-based type charges.” Specifically, he mentioned Section 1519 (which relates to obstructing an official effort and was widely expected because it was listed on the F.B.I. search warrant affidavit), but also a new one: Section 1512, which criminalizes witness tampering or other means of obstructing an official proceeding.

Trusty also said he believed there was a conspiracy count, as has been reported. But he cautioned that he was not looking at the document and that it was vague in places. “This is not biblically accurate, because I’m not looking at a charging document. I’m looking at a summary sheet. There’s language in there that might actually be reflecting a single count instead of two, but I think there was a conspiracy count as well,” he said. He added that the team had not been told of anyone else being indicted.

Appears there is a Gang of 8 briefing underway in the Capitol.

Schumer and McConnell have both headed into the Senate SCIF, as have Intel Committee heads from both chambers.

Trump learns he's a special counsel 'target,' turns to GOP allies

As Donald Trump is formally notified of his status as the target of a criminal probe, he’s begging congressional Republicans to help. This won’t work.

.........

For reasons unknown, Trump genuinely seems to believe that congressional Republicans have a role to play in his intensifying legal troubles. Indeed, he and his team have been unsubtle about this for weeks: In late April, the Republican’s lawyers sent a strange, 10-page letter to the House Intelligence Committee, insisting that a “legislative solution,” to be approved by Congress, is “required” to prevent federal prosecutors from pursuing the case further.

The letter proposed that the Justice Department “should be ordered to stand down” — as if members of the legislative branch have the authority to direct federal prosecutors to drop a case. (They have no such authority.)

I honestly don’t know what he expects congressional Republicans to do. Congress has no control over who is or isn’t indicted. It’s possible that Trump has imagined a scenario in which lawmakers pass a bill to defund the special counsel’s office, thereby derailing the investigation, but even if the GOP-led House were to take up such a measure, it obviously couldn’t pass the Democratic-led Senate or receive President Joe Biden’s signature

What we’re seeing, in other words, is a desperate criminal suspect scrambling to find someone, anyone, who can help rescue him from a crisis of his own making. Whether Trump understands this or not, his pleas won’t work.

BREAKING Feds inform Trump he is target in Mar-a-Lago document case

Trump’s lawyers told he is target in Mar-a-Lago documents investigation
Move dramatically raises stakes for former president as investigation appears to near its conclusion

Federal prosecutors formally informed Donald Trump’s lawyers last week that the former US president is a target of the criminal investigation examining his retention of national security materials at his Mar-a-Lago resort and obstruction of justice, according to two people briefed on the matter.

The move dramatically raises the stakes for Trump as the investigation appears to near its conclusion after taking evidence before a grand jury in Washington and a previously unknown grand jury in Florida that was impaneled last month.

Trump’s lawyers were notified before they met on Monday with the special counsel Jack Smith leading the Mar-a-Lago documents case and the senior career official in the deputy attorney general’s office and made the case that prosecutors should not indict the former president in the matter.

Federal prosecutors have notified Donald Trump that he is a criminal target and likely to be indicted imminently in a probe into alleged classified documents – even as the Justice Department declined to delay charges to give time to investigate allegations of witness tampering submitted by the former president’s legal team, according to multiple people on Wednesday familiar with the case.

If Trump documents probe leads to charges, bulk of indictment would be in S. Florida

People familiar with the matter said special counsel Jack Smith wants to base the case where most of possible misconduct happened

Justice Department prosecutors are planning to bring a significant portion of any charges stemming from the possible mishandling of classified documents at Mar-a-Lago, the home of former president Donald Trump, at a nearby federal court in south Florida, according to people familiar with the matter.

The legal rationale for such a move is that the bulk of the conduct at issue in the investigation occurred in the southern district of Florida, in and around Trump’s Palm Beach residence and private club, even if much of the investigation — led by special counsel Jack Smith — has been handled by a grand jury in Washington. D.C., these people said.

That approach by prosecutors does not rule out the possibility of some charges, such as perjury or false statements, being filed in the nation’s capital in connection with out of grand jury appearances or law enforcement interviews that took place there, according to these people, who spoke on condition of anonymity to describe the internal discussions.

Former Trump aide arrives at Miami courthouse to appear before grand jury in classified documents pr

Taylor Budowich, who has worked as a spokesman for Donald Trump, has arrived at the federal courthouse in Miami to appear before a grand jury as part of special counsel Jack Smith’s investigation into the former president’s handling of classified documents.

Budowich and his attorney, Stanley Woodward, declined to answer questions as they arrived.

Still aligned closely with the former president, Budowich now runs a super PAC backing Trump called MAGA, Inc.

The grand jury based in southern Florida has heard testimony from multiple witnesses in recent weeks as part of the federal investigation that has relied for months on grand juries in Washington, DC, to help gather evidence and witness testimony.
